May Term 1834

In the name of God Amen: I Kinchen Cheatham of the State of North Carolina and County of Wilkes, being of sound and perfect mind and memory, blessed be God, do this seventeenth day of April in the year of our Lord One thousand eight Hundred and thirty four, make and publish this my last will and testament in the manner following that is to say the first of all I recommend my soul to God who gave it to me and my body to the earth to be buried in a Christian like manner. I request all my just and lawful debts to be paid out of my personal property and then I give and bequeath unto my beloved wife Charity all my lands and my Negro girl named Fan, with all the remains of my personal property during her life time or widowhood. this land and Negro with her increase the right thereof not to be transferred nor sold by no contract of my beloved wife. NB. But at my wife's death or in case of marriage I further give all my effects and property unto my seven beloved children, Christopher, James, Henry, William, Wiat, Elizabeth & Rebecca. This property to be sold and the money from the sale of the said property to be equally divided between each and every one of my aforementioned and beloved children.

And I hereby make and ordain my trusty friend Ellis Queen executor of this my last will and testament. In Witness whereof I the said Kinchen Cheatham have to this my last will and testament set my hand and seal the day and date above written.

This within Will was duly proven in open Court by the oath of Levi Brotherton & to be recorded and registered & Ellis Queen qualified as executor of said Will.

Know all men by theses presents that we William Mastin, Alexander Church & David Gray are held and firmly bound unto the State of North Carolina in the Sum of Fifteen Hundred Dollars current money to be paid to said State to them which payment well and truly to be made we bind ourselves our heirs executors and administrators jointly and severally by these presents.

Sealed with our Seals and dated this 6th day of Nov 1845

The condition of the obligation is such that if the above bounden Wm Mastin Administrator of all and singular the goods, chattels, rights and credits of Kinchen Chatham deceased with the Will do make or cause to be made a true and perfect inventory of all and singular the goods and chattels, rights & credits of the deceased, which have or shall come to the hands, knowledge or possession of the said Wm Mastin or into the hands or possession of hands of person or persons for him; and the same to be made, do exibit or cause to be exhibited into Wilkes Coutny Court within the time prescribed by law after the date of these presents. And the same goods chattels and credits and all other the goods chattels & credits of the deceased at the time of his death or which at anytime herefafter shall come into the hands or possession of the said Wm Mastin or into the hands or possession of any person or persons for him do well and truly administer according to law; and further do make or cause to be made a true and just account of his said administration, agreeably to law, after the date of these presents; and all the rest and residue of the said goods, chattels & credits which shall be found renaming upon said administrator account (the same being first allowed by the Governor & Council, Superior or County Courts) shall deliver and pay unto such perosn or persons, respectivley, as the same shall become due, pursuant to the true intent & meaning of the act in that case made and provided. And if it shall appear that any Will or Testament was made by the deceased, and the executor or executors therein named do exhibit the same in court, making request to have it allowed and approved of accordingly if the said Wm Mastin above bounden being thereunto required, do render and deliver the said letters on administraion (approbation of such testament being first had and made in the said Court) then this obligation to be void, otherwise to remain in full force & virtue.
